Workshop Registration, Cancellation Policy, and Liability Waiver

PLEASE READ CAREFULLY. THIS IS A LEGALLY BINDING AGREEMENT.
By registering for, purchasing, or participating in any workshop, class, event, open studio session, or activity offered by Makers Mercantile & Studio (“Studio”), and by selecting “I Agree,” the participant (“Participant”) acknowledges that they have read, understand, and agree to be legally bound by the following terms and conditions.

1. Registration, Fees, and No-Refund Policy

All workshops, classes, and projects are prepared on a made-to-order basis, and registration reserves a seat exclusively for the Participant. ALL REGISTRATION FEES ARE NON-REFUNDABLE, regardless of attendance, completion, or early departure.

The Studio reserves the right to cancel, reschedule, or modify any workshop due to low enrollment, instructor availability, weather, or circumstances beyond its control. In such cases, the Studio may issue a studio credit or reschedule the workshop at its sole discretion.

2. Cancellation, Rescheduling, and Studio Credits

Participants who are unable to attend a scheduled workshop must provide written notice of cancellation at least forty-eight (48) hours prior to the scheduled start time to be eligible for a full studio credit. Studio credits:

  • Are non-transferable

  • Have no cash value

  • Must be redeemed within ninety (90) days of issuance

Cancellations made with fewer than forty-eight (48) hours’ notice will receive a studio credit minus a $15 studio rescheduling fee.

No-call/no-show participants forfeit all fees and are not eligible for refunds, credits, or rescheduling under any circumstances.

All cancellation or rescheduling requests must be submitted in writing via email to Info@MakersMercantileStudio.com.

3. Participant Responsibilities

Participants agree to:

  • Follow all verbal and written instructions provided by Studio staff and instructors

  • Use tools, equipment, and materials only as instructed

  • Conduct themselves in a safe, respectful, and responsible manner at all times

The Studio reserves the right to remove any participant whose behavior is deemed unsafe, disruptive, or inappropriate, without refund or credit.

4. Assumption of Risk

Participant understands and acknowledges that participation in Studio activities involves inherent and foreseeable risks, including but not limited to:

  • Cuts, scrapes, burns, or puncture wounds

  • Allergic reactions or sensitivities to materials, paints, adhesives, resins, woods, fabrics, or chemicals

  • Physical strain, injury, or illness

  • Damage to personal property or clothing

Participant voluntarily and knowingly assumes all risks, whether known or unknown, foreseen or unforeseen, associated with participation in Studio activities.

5. Release and Waiver of Liability (Colorado Law)

To the maximum extent permitted under Colorado law, Participant hereby releases, waives, discharges, and covenants not to sue Makers Mercantile & Studio, including its owners, officers, employees, instructors, volunteers, agents, and affiliates (collectively, “Released Parties”), from any and all claims, demands, causes of action, damages, or liabilities, including those arising from the negligence of the Released Parties, related to or arising out of participation in Studio activities.

This release does not apply to claims resulting from gross negligence or willful misconduct where prohibited by law.

6. Personal Property, Attire, and Studio Environment

Aprons are provided as a courtesy; however, Participants acknowledge that Studio activities may result in stains, damage, or destruction of clothing or personal items. Participants agree to dress appropriately and assume all responsibility for their belongings.

The Studio is not responsible for loss, theft, or damage to personal property brought onto the premises.

7. Medical Conditions and Physical Capability

Participant represents that they are physically and mentally capable of participating in Studio activities and have disclosed any relevant allergies, sensitivities, or medical conditions prior to participation. The Studio does not provide medical care and is not responsible for medical treatment arising from participation.

8. Minors

Participants must be at least 18 years of age, unless a minor is expressly permitted to attend a workshop. In such cases, a parent or legal guardian must complete and accept this agreement on behalf of the minor, and assumes full responsibility for the minor’s participation.

9. Photography and Media Release

Participant grants the Studio permission to photograph or record participation in Studio activities and to use such images or recordings for marketing, promotional, or educational purposes without compensation, unless the Participant provides written opt-out notice prior to the event.

10. Severability and Governing Law

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by and construed in accordance with the laws of the State of Colorado.

11. Acknowledgment and Acceptance

By selecting “I Agree,” Participant affirms that they have carefully read this agreement, understand its terms, and voluntarily agree to be legally bound by it.
